Terms of Service

These Terms govern your access to and use of DaktariDesk. By creating an account or using our service, you agree to be bound by these Terms.

SECTION 01

Acceptance of Terms

By accessing or using DaktariDesk, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the service.

If you are using DaktariDesk on behalf of a medical practice, clinic, or organization, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and the entity.

SECTION 02

Service Description

DaktariDesk is an appointment reminder service that:

Integrates with your Google Calendar to detect upcoming patient appointments
Extracts patient contact information from calendar event details
Sends automated appointment reminders via WhatsApp (and SMS as fallback)
Provides a dashboard to track reminder delivery status and patient responses
Offers a Chrome extension for quick access to appointment and reminder management

Note: DaktariDesk is an administrative tool for appointment management. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

SECTION 03

Eligibility

To use DaktariDesk, you must:

Be a licensed medical professional, healthcare administrator, or authorized representative of a registered medical practice
Be at least 18 years of age
Have a valid Google account with Google Calendar enabled
Have the legal authority to send communications to your patients via WhatsApp or SMS
Comply with all applicable Kenyan laws and regulations, including the Kenya Data Protection Act 2019
SECTION 04

Account Registration

You create an account by signing in with Google. By doing so, you agree to:

Provide accurate and complete information during registration
Keep your account credentials secure and confidential
Notify us immediately if you suspect unauthorized access to your account
Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.

SECTION 05

Subscriptions and Billing

Free Trial

New accounts receive a 14-day free trial with full access to all features. No payment information is required to start a trial.

Paid Plans

Paid subscriptions are billed monthly. Pricing is displayed on our website and may be updated with 30 days' notice. Payments are processed by Paystack.

Cancellation

You may cancel your subscription at any time from the Settings page. You retain access until the end of your current billing period. No refunds for partial months.

Message Limits

Each plan includes a monthly allocation of WhatsApp messages. If you exceed your limit, reminders will pause until the next billing cycle or you upgrade.

SECTION 06

Acceptable Use

You agree not to use DaktariDesk to:

Send unsolicited marketing messages, spam, or promotional content unrelated to appointment reminders
Transmit content that is unlawful, threatening, abusive, or otherwise objectionable
Attempt to gain unauthorized access to other users' accounts or data
Reverse-engineer, decompile, or disassemble any part of the service
Use the service in a way that could damage, disable, or impair our infrastructure
Share patient data extracted from calendar events with unauthorized third parties
SECTION 07

Google Calendar Integration

DaktariDesk accesses your Google Calendar through the Google OAuth 2.0 protocol. By connecting your Google account, you:

Grant DaktariDesk read-only access to your Google Calendar events
Acknowledge that we extract patient names and phone numbers from calendar event details
Understand that calendar data is synced periodically and temporarily stored for processing
Can revoke access at any time through your Google Account Permissions

Important: We only access calendar data necessary for appointment reminders. We do not modify, delete, or create calendar events. Our use of Google user data complies with the Google API Services User Data Policy.

SECTION 08

WhatsApp Messaging

DaktariDesk sends appointment reminders through the WhatsApp Business API. You acknowledge and agree that:

You are responsible for obtaining appropriate consent from patients before sending them messages
Messages are sent using pre-approved WhatsApp message templates
Message delivery depends on the patient having an active WhatsApp account
We are not responsible for messages that fail to deliver due to network issues, invalid phone numbers, or the recipient not having WhatsApp
SMS may be used as a fallback when WhatsApp delivery fails, subject to your plan

You must comply with Meta's WhatsApp Business Policy and all applicable telecommunications regulations.

SECTION 09

Intellectual Property

All content, features, and functionality of DaktariDesk — including the software, design, text, graphics, and logos — are owned by DaktariDesk and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the service for its intended purpose during your active subscription.

You retain ownership of all data you input into the service, including calendar data and patient information. We do not claim any rights to your data beyond what is necessary to provide the service.

SECTION 10

Limitation of Liability

To the maximum extent permitted by Kenyan law:

DaktariDesk is provided on an "as is" and "as available" basis without warranties of any kind
We do not guarantee uninterrupted, error-free, or secure operation of the service
We are not liable for any missed appointments, failed message deliveries, or patient no-shows
Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim
We are not liable for indirect, incidental, consequential, or punitive damages

Healthcare disclaimer: DaktariDesk is a communication tool only. It does not replace professional medical judgment, patient management systems, or direct patient-provider communication. You remain solely responsible for patient care and clinical decision-making.

SECTION 11

Termination

Termination by You

You may close your account at any time from the Settings page. Your subscription will be cancelled and your data deleted in accordance with our Privacy Policy.

Termination by Us

We may suspend or terminate your access if you breach these Terms, fail to pay subscription fees, or use the service in a manner that harms other users or our infrastructure.

Effect of Termination

All pending reminders will be cancelled and will not be sent
Your Google Calendar connection will be revoked on our end
Account data will be deleted within 30 days, except where retention is required by law
Billing records will be retained for 7 years per Kenyan tax requirements
SECTION 12

Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms or your use of DaktariDesk shall be subject to the exclusive jurisdiction of the courts of Kenya.

SECTION 13

Changes to These Terms

We may update these Terms from time to time. When we make changes:

We will notify you via email at least 14 days before changes take effect
The "Last updated" date at the top of this page will be revised
Material changes will be highlighted in-app when you next log in
Continued use of DaktariDesk after the effective date constitutes acceptance of the updated Terms
